1. Acceptance of Terms
By accessing or using Callytics ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
The Service is provided by Callytics Ltd, a company registered in England and Wales. These terms constitute a legally binding agreement between you and Callytics Ltd.
2. Description of Service
Callytics provides call tracking, recording, and analytics services for businesses. This includes:
• Provision of UK tracking phone numbers
• Call forwarding and routing
• Call recording and storage
• AI-powered transcription and analysis
• Marketing attribution and analytics
• API access for integrations
The specific features available to you depend on your subscription plan.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use
You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or your organisation.
4. Acceptable Use
You agree not to use the Service for any unlawful purpose or in violation of these terms. Prohibited activities include:
• Recording calls without appropriate consent or legal basis
• Using the Service for harassment, spam, or fraud
• Attempting to gain unauthorised access to our systems
• Reselling or sublicensing the Service without permission
• Violating any applicable laws or regulations
We reserve the right to suspend or terminate accounts that violate these terms.
5. Call Recording Compliance
If you use our call recording feature, you are responsible for compliance with all applicable laws, including:
• Informing callers that calls may be recorded
• Obtaining any required consent for recording
• Complying with data protection regulations (including UK GDPR)
• Following industry-specific regulations if applicable
Callytics provides tools to help with compliance (such as recording announcements) but does not provide legal advice. You should consult with a legal professional regarding your specific obligations.
6. Pricing and Payment
Subscription fees are billed monthly or annually as specified in your plan. By subscribing, you authorise us to charge your payment method for the applicable fees.
• Prices may change with 30 days notice
• Overage charges apply when you exceed included minutes
• Additional numbers are charged at the current rate
• Refunds are provided at our discretion
All prices are shown in GBP and exclude VAT where applicable.
7. Cancellation
You may cancel your subscription at any time through your account dashboard. Upon cancellation:
• Your subscription will remain active until the end of the current billing period
• You will retain access to call data for 30 days after cancellation
• Tracking numbers will be released and cannot be recovered
• No refunds are provided for partial billing periods
We recommend exporting any data you wish to keep before cancelling.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. We process personal data in accordance with UK GDPR and the Data Protection Act 2018.
You retain ownership of your call data and recordings. We act as a data processor on your behalf and will only use your data to provide the Service.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may:
• Perform scheduled maintenance with reasonable notice
• Experience occasional outages due to factors beyond our control
• Modify or discontinue features with appropriate notice
Our target uptime is 99.9% and we provide service credits for significant outages as detailed in our SLA (available for Scale plan customers).
10. Limitation of Liability
To the maximum extent permitted by law, Callytics shall not be liable for:
• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or data
• Business interruption costs
• Damages exceeding the fees paid in the 12 months prior to the claim
This limitation applies regardless of the legal theory upon which the claim is based.
11. Indemnification
You agree to indemnify and hold harmless Callytics and its employees from any claims, damages, or expenses arising from:
• Your use of the Service
• Your violation of these terms
• Your violation of any third-party rights
• Your call recording practices
12. Changes to Terms
We may update these terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
13. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
